TERMS OF USE / TERMS & CONDITIONS

OnCall Acting Drivers

By accessing or using the OnCall Acting Drivers platform, you agree to comply with and be bound by these Terms & Conditions. These terms govern the use of our services and define the rights and responsibilities of clients and the Company.

1. DEFINITIONS
  • Company / We / Us: OnCall Acting Drivers, a platform owned and operated by The E2o Technologies Private Limited.
  • Client / You: Any individual or organization booking or using our services.
  • Driver: A professional driver assigned through the platform, holding a valid Indian Driving Licence.
  • Service: Temporary, substitute, or on-demand driving services provided under these Terms.
2. ELIGIBILITY & LEGAL COMPLIANCE (INDIA)

To avail of the service, the following eligibility and legal requirements must be met:

Client & Vehicle Requirements
  • The Client must be at least 18 years of age and legally competent under the Indian Contract Act, 1872.
  • The vehicle must comply with the Motor Vehicles Act, 1988, including:
    • Valid Registration Certificate (RC)
    • Valid Insurance Policy (including third-party and driver coverage)
    • Valid Pollution Under Control (PUC) Certificate
    • Valid Fitness Certificate (for commercial vehicles, where applicable)
Driver Standards
  • Hold a valid Indian Driving Licence (LMV / MCWG / HMV as applicable).
  • Are medically fit as per motor vehicle standards.
  • Will not operate vehicles outside their licence class.
3. SCOPE OF SERVICES
  • Drivers are provided only to operate the Client’s vehicle.
  • Services are limited strictly to driving duties.
  • Activities such as refueling, loading/unloading, vehicle repair, or maintenance are excluded unless agreed in advance.
  • Services are provided only within Indian jurisdictions and in compliance with traffic laws.
4. CLIENT RESPONSIBILITIES

By booking the service, the Client agrees to:

  • Provide accurate trip details (pickup, drop, timing, route).
  • Ensure the vehicle is roadworthy, insured, and legally compliant.
  • Bear expenses such as fuel, tolls, parking, and permits.
  • Not request the driver to:
    • Violate traffic laws.
    • Exceed speed limits.
    • Drive under unsafe or unlawful conditions.
  • Maintain respectful conduct and a safe working environment for the driver.
5. DRIVER RESPONSIBILITIES
  • Follow the Motor Vehicles Act, 1988 and applicable traffic rules.
  • Not operate a vehicle under the influence of alcohol or drugs.
  • Follow road safety norms including seatbelt and helmet usage.
  • Refuse service if the vehicle is unsafe, illegal, or unfit.
  • Maintain professionalism, punctuality, and courtesy.
6. BOOKING, PAYMENT & CANCELLATION
  • Bookings may be made via website, mobile app, phone, or authorized partners.
  • Service charges are payable in advance or immediately after service completion.
Cancellation Charges
  • Free cancellation: More than 2 hours before service start.
  • 50% charge: Cancellation within 2 hours of service start.
  • 100% charge: Client no-show.

Refunds, if applicable, are processed as per the Refund & Cancellation Policy within 7–10 business days.

7. LIABILITY & INSURANCE
  • The Client is solely responsible for ensuring valid insurance coverage for the vehicle and acting driver.
  • The Company shall not be liable for:
    • Vehicle breakdowns or pre-existing defects.
    • Loss of personal belongings inside the vehicle.
    • Delays due to traffic, weather, strikes, or force majeure events.
  • Traffic fines or legal penalties shall be the Client’s responsibility unless caused by proven driver negligence.
8. SERVICE TERMINATION

The Company may immediately withdraw services if:

  • The Client engages in abusive, unlawful, or unsafe behavior.
  • The vehicle is found illegal or unfit for road use.

The Client may terminate the service if the driver behaves unprofessionally or violates traffic laws.

9. INDEMNITY

The Client agrees to indemnify and hold harmless the Company, its employees, and drivers from any claims, damages, or liabilities arising due to:

  • Violation of traffic laws.
  • Vehicle insurance or mechanical deficiencies.
  • Incorrect or misleading booking information.
10. INTELLECTUAL PROPERTY

All website, application content, trademarks, and branding belong exclusively to OnCall Acting Drivers.

Unauthorized copying, reproduction, or misuse is strictly prohibited.

11. MODIFICATIONS TO TERMS
  • The Company reserves the right to modify these Terms to comply with applicable laws.
  • Updated Terms shall be effective upon publication on the website or mobile application.
12. GOVERNING LAW & JURISDICTION

These Terms are governed by the laws of India, including the Motor Vehicles Act, 1988.

All disputes shall be subject to the exclusive jurisdiction of the courts of Tamil Nadu, India.

13. ACKNOWLEDGMENT

By booking or using the service, you acknowledge that:

  • Your vehicle complies with Indian road laws.
  • You meet the eligibility criteria.
  • You have read, understood, and agreed to these Terms & Conditions.
