Definitions

• Company / We / Us – Refers to OnCall Acting Drivers.
• Client / You – Refers to the person or organization booking our services.
• Driver – Refers to the professional driver assigned by the Company, holding a valid Indian Driving Licence as per law.
• Service – Refers to temporary, substitute, or on-demand driving services provided under these Terms.

Eligibility (As per Indian Standards)

To avail of our services: The driver must be at least 18 years of age and legally competent to enter into a contract under the Indian Contract Act, 1872.

• The vehicle must be compliant with the Motor Vehicles Act, 1988, and must have:
• Valid Registration Certificate (RC),
• Valid Insurance Policy covering third-party and driver liability,
• Valid Pollution Under Control (PUC) Certificate,
• Valid Fitness Certificate (for commercial vehicles).
• Drivers provided by OnCall Acting Drivers will:
• Hold a valid Indian Driving Licence (LMV/MCWG/HMV as applicable).
• Be medically fit as per Motor Vehicle fitness requirements.
• Not be permitted to drive vehicles outside their licence class.

Scope of Services

• Acting drivers are provided only for operating the Client’s vehicle.
• Services are limited to driving duties; no extra tasks unless agreed in advance.
• Services will be provided only within Indian jurisdictions covered by traffic laws.
• Drivers will comply with all traffic regulations and safety norms.

Client Responsibilities

By booking our service, the Client agrees to:

• Provide accurate details of the trip including pickup/drop-off, timing, and route.
• Ensure the vehicle has valid permits, insurance, and PUC.
• Cover expenses for fuel, toll, parking, and inter-state permits during the trip.
• Not request the driver to:
• Exceed speed limits,
• Violate traffic laws,
• Drive under unsafe conditions.
• Treat the driver with respect and provide a safe environment.

Driver Responsibilities

Our drivers are expected to:

• Drive responsibly, complying with the Motor Vehicles Act, 1988 and Central Motor Vehicle Rules.
• Not drive under the influence of alcohol, drugs, or intoxicants.
• Follow traffic signals, speed limits, and safety laws (helmet, seatbelts, etc.).
• Refuse to operate a vehicle if it is unfit, unsafe, or illegal.
• Maintain professionalism, punctuality, and courtesy.

Booking, Payment & Cancellation

Bookings can be made via website, mobile app, phone, or authorized partners. Service charges are payable in advance or immediately after completion.

• Cancellations:
• Free if made more than 2 hours before service start.
• 50% fee if canceled within 2 hours of start.
• 100% charge for Client no-show.
• Refunds within 7–10 business days as per Refund Policy.

Liability & Insurance

The Client must ensure the vehicle is insured as per Indian law, covering acting drivers.

• OnCall Acting Drivers is not liable for:
• Vehicle breakdowns, pre-existing defects, or fitness issues.
• Loss of belongings inside the vehicle.
• Delays caused by traffic, weather, strikes, or force majeure.
• Traffic challans, fines, or legal penalties will be the Client’s responsibility, unless caused by proven negligence of the driver.

Service Termination

The Company may immediately withdraw services if:

• The Client engages in abusive, unlawful, or unsafe behavior, or
• The vehicle is found illegal or unfit for road use.
• The Client may terminate services if the driver is unprofessional or violates laws.

Indemnity

The Client agrees to indemnify OnCall Acting Drivers, its employees, and drivers from claims, damages, or liabilities arising from:

• Violation of traffic laws by the Client,
• Mechanical or insurance deficiencies of the vehicle,
• Incorrect or misleading booking information.

Intellectual Property

• All website, app, and branding content belongs to OnCall Acting Drivers.
• Unauthorized use is strictly prohibited.

Modifications to Terms

• OnCall Acting Drivers reserves the right to update these Terms in compliance with Indian laws.
• Updated Terms will be effective once published on the website.

Governing Law & Jurisdiction

• These Terms are governed by the laws of India, including the Motor Vehicles Act, 1988.
• Any disputes shall be subject to the jurisdiction of the courts in [Insert City/State].

Acknowledgment

• By booking a driver, you confirm that your vehicle complies with Indian road laws, you meet the eligibility criteria, and you accept these Terms & Conditions.
